Why 4.3 or later!?!?!?

I have an iPhone 3G and one one the games I like the most its Snake 97 ! I bought it last month, but now I can´t play it anymore because the last version that in iPhone 3G can support is 4.2. !!! I paid 0.99 dollars for it and I want to play !
